The Indian government has long permitted the use of in vitro fertilization (IVF) treatments to help couples struggling with infertility conceive a child. This process, which involves fertilizing an egg outside of the body and then implanting it into the womb, is often successful in overcoming infertility issues. In addition, India has also allowed for the genetic testing of embryos during IVF treatment in order to avoid complications associated with conceiving a child who may have genetic abnormalities. However, according to the latest ART Bill 2020, there is now an upper age limit for conception using assisted conception/IVF in India. The new bill states that women must be 50 years old or younger and men must be 55 years old or younger. Surrogacy is not currently permitted in India.

Egg Donation and Surrogacy Law

Egg donation is permitted in India and the donors remain anonymous. All donors should be screened for any genetic or psychological issues. The laws surrounding surrogacy in India are complex. Recently, the Indian government made it illegal for foreign intended parents to complete a surrogacy in India. Only Indian intended parents who have been married for at least five years are allowed to go ahead with a commercial surrogacy in India.
